Montana Consumer Data Privacy Act (MCDPA) Notice – Wind ‘n’ Sails
Montana Privacy Rights
This section provides additional information for Montana residents under the Montana Consumer Data Privacy Act (MCDPA). The terms used in this section have the same meaning as in the MCDPA. This section does not apply to deidentified or publicly available information as defined by the MCDPA.

Data “Selling” and Targeted Advertising
Wind ‘n’ Sails processes personal data for targeted advertising as defined under the MCDPA. This may include:
- Personal Identifiers
- Internet Activity
- Commercial Information
This allows us to display advertisements tailored to your interests.
- Opt-Out: You have the right to opt out of these data practices by visiting the Privacy Preferences page.
- No Sale of Data: Wind ‘n’ Sails does not sell personal data in exchange for monetary or other valuable consideration.
Profiling
The MCDPA grants consumers the right to opt out of automated profiling that impacts legal, employment, financial, or insurance-related decisions.
Wind ‘n’ Sails does not engage in profiling that produces legal or similarly significant effects on consumers.
Your MCDPA Rights
Right to Access
You have the right to:
- Confirm whether Wind ‘n’ Sails is processing your personal data.
- Access the personal data we have collected about you.
- Receive a portable and readily usable copy of your personal data to transmit it to another controller.
Note: If you make more than one access request within a 12-month period, a small processing fee may apply.
Right to Delete
You have the right to request that we delete any personal data we have collected. Upon verification, we will:
- Permanently delete your personal data from our records.
- Direct our processors to delete the same data.
However, some data may be retained if necessary for legal, security, or business purposes, as permitted by law.
Right to Non-Discrimination
Wind ‘n’ Sails will not discriminate against customers who exercise their privacy rights. This means:
- No difference in pricing, product quality, or service levels.
- No retaliation against employees, job applicants, or independent contractors who exercise their privacy rights.
Right to Opt-Out
Sale of Personal Data
Wind ‘n’ Sails does not sell your personal data as defined by the MCDPA.
Targeted Advertising
You have the right to opt out of targeted advertising by visiting the Privacy Preferences page.
Profiling
Wind ‘n’ Sails does not engage in profiling that results in legal or similarly significant effects on consumers.
Authorized Agents & Opt-Out Preference Signals
Authorized Agents
You may authorize an agent to submit an opt-out request on your behalf. This can be done through:
- A web link or browser setting.
- A Global Privacy Control (GPC) signal or other similar preference settings.
We will process the request once we authenticate your identity and verify the agent’s authority.
Opt-Out Preference Signals
Certain browsers allow automatic transmission of an opt-out preference signal (such as Global Privacy Control (GPC)). When detected, Wind ‘n’ Sails will:
- Apply a U.S. Privacy String setting to prevent third-party tracking on our site.
- Link your opt-out request to your browser identifier rather than account information (since we cannot associate browser activity with your account).
To enable GPC, refer to your browser settings or install a supported browser extension.
Right to Correct
You have the right to correct inaccuracies in your personal data, considering its nature and processing purposes.
Authenticating Your Privacy Request
To protect your data, Wind ‘n’ Sails verifies all privacy requests before processing them.
- We will match the information you provide with existing records.
- If additional verification is required, we may request further details.
- If we cannot verify your request, we may deny it.
For opt-out requests, authentication is not required. However, we may deny the request if we have a good faith, reasonable, and documented belief that the request is fraudulent.
Right to Appeal
If Wind ‘n’ Sails denies your privacy request, you have the right to appeal within 90 days of our decision.
To submit an appeal request, visit the Privacy Preferences page and select "Appeal a Decision" as the request type.
If you are unable to resolve the issue directly with us, you may file a complaint with the Montana Attorney General’s Office.
