Nebraska Data Privacy Act (NDPA) Notice – Wind ’n’ Sails
Nebraska Privacy Rights
This section provides additional information for Nebraska residents under the Nebraska Data Privacy Act (NDPA). The terms used in this section have the meanings given to them under the NDPA.
This section applies to Nebraska residents acting in an individual or household context and does not apply to individuals acting in a commercial or employment context or to information otherwise excluded from the NDPA, including deidentified data and publicly available information.

Targeted Advertising and Sale of Personal Data
Wind ’n’ Sails may process certain personal data for targeted advertising as defined under the NDPA. Depending on how you interact with us and the services and technologies we use, this may include categories of personal data such as:
- Personal Identifiers
- Internet or Other Electronic Network Activity
- Commercial Information
This processing may allow us and our advertising partners to provide advertisements that are more relevant to your interests.
- Targeted Advertising: You have the right to opt out of the processing of your personal data for targeted advertising by visiting our Privacy Preferences page.
- Sale of Personal Data: Wind ’n’ Sails does not sell personal data for monetary or other valuable consideration as defined by the NDPA.
Profiling
Wind ’n’ Sails does not engage in profiling in furtherance of decisions that produce legal or similarly significant effects concerning consumers, as those terms are defined under the NDPA.
Your NDPA Rights
Subject to applicable exceptions and limitations, Nebraska residents may have the following rights regarding their personal data:
Right to Confirm and Access
You have the right to confirm whether Wind ’n’ Sails is processing your personal data and, if so, to access that personal data.
Right to Correct
You have the right to request correction of inaccuracies in your personal data, taking into account the nature of the personal data and the purposes for which it is processed.
Right to Delete
You have the right to request deletion of personal data provided by or obtained about you, subject to applicable exceptions and limitations under the NDPA.
Right to Data Portability
When your personal data is available in a digital format and processed by automated means, you have the right to obtain a copy of personal data that you previously provided to us in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the data to another controller without hindrance.
Right to Opt Out
You have the right to opt out of the processing of personal data for:
- Targeted advertising
- The sale of personal data
- Profiling in furtherance of decisions that produce legal or similarly significant effects concerning you
Wind ’n’ Sails does not sell personal data for monetary or other valuable consideration as defined by the NDPA and does not engage in profiling in furtherance of decisions that produce legal or similarly significant effects concerning consumers.

Right to Non-Discrimination
Wind ’n’ Sails will not unlawfully discriminate against you for exercising your rights under the NDPA, including by denying goods or services, charging a different price or rate, or providing a different level or quality of goods or services because you exercised an applicable privacy right, except as otherwise permitted by law.
Sensitive Data
The NDPA provides additional protections for sensitive data, which may include certain information concerning racial or ethnic origin, religious beliefs, health diagnoses, sexual orientation, citizenship or immigration status, genetic or biometric data used to uniquely identify an individual, personal data collected from a known child, and precise geolocation data.
Where the NDPA requires consent before processing sensitive data, Wind ’n’ Sails will obtain the required consent. Personal data of a known child will be processed in accordance with applicable requirements, including the Children’s Online Privacy Protection Act (COPPA) where required.
Wind ’n’ Sails does not sell sensitive personal data without the consent required by applicable law.
Authorized Agents and Opt-Out Requests
Nebraska consumers may designate an authorized agent to submit certain opt-out requests on their behalf, including requests to opt out of targeted advertising or the sale of personal data.
An authorized agent may use technology indicating the consumer’s intent to opt out, which may include a website link, browser setting or extension, or a global setting on an electronic device.
Where permitted by the NDPA, we may take commercially reasonable steps to verify the identity of the consumer and the authority of the authorized agent to act on the consumer’s behalf.
Submitting and Authenticating Privacy Requests
You may exercise your applicable Nebraska privacy rights through our Privacy Preferences page or by contacting us at privacy@windnsails.com.
We may take reasonable steps to authenticate your identity before fulfilling certain requests. The information requested for authentication will depend on the nature of the request and the personal data involved.
If we cannot authenticate a request using commercially reasonable efforts, we may request additional information reasonably necessary to authenticate your identity and the request.
You are not required to create a new account to exercise your rights under the NDPA, although we may require you to use an existing account where permitted by law.
Response Timing and Fees
We will respond to an authenticated consumer request without undue delay and generally within 45 days after receiving the request.
When reasonably necessary because of the complexity or number of requests, we may extend the response period once by an additional 45 days. If an extension is required, we will notify you within the initial 45-day period and explain the reason for the extension.
Information provided in response to a consumer request will generally be provided free of charge up to twice annually per consumer.
If a request is manifestly unfounded, excessive, or repetitive, we may charge a reasonable fee to cover the administrative costs of complying with the request or decline to act on the request, as permitted by the NDPA.
Appeals
If we decline to take action on your privacy request, we will provide the reason for our decision and instructions explaining how you may appeal that decision.
You may submit an appeal through our Privacy Preferences page by selecting “Appeal a Decision”, if available, or by contacting privacy@windnsails.com and clearly identifying your request as a privacy appeal.
We will respond in writing to an appeal within 60 days after receiving it, including an explanation of the action taken or not taken and the reasons for our decision.
If we deny your appeal, we will provide information about how you may contact the Nebraska Attorney General to submit a complaint.
