New Jersey Data Privacy Act (NJDPA) Notice – Wind ’n’ Sails
New Jersey Privacy Rights
This section provides additional information for New Jersey residents under the New Jersey Data Privacy Act (NJDPA). The terms used in this section have the same meaning as under the NJDPA. This section does not apply to deidentified or publicly available information as defined under the NJDPA.

Data “Selling” and Targeted Advertising
Wind ’n’ Sails processes personal data for targeted advertising as defined under the NJDPA. Depending on your interactions with us, this may include categories of personal data such as:
- Personal Identifiers
- Internet or Other Electronic Network Activity
- Commercial Information
This processing allows us and our advertising partners to provide advertisements that may be more relevant to your interests.
- Opt-Out: You have the right to opt out of the processing of your personal data for targeted advertising by visiting our Privacy Preferences page.
- No Sale of Personal Data: Wind ’n’ Sails does not sell personal data as defined under the NJDPA.
Profiling
Wind ’n’ Sails does not engage in profiling in furtherance of decisions that produce legal or similarly significant effects concerning consumers, such as decisions concerning financial or lending services, housing, insurance, education enrollment or opportunity, criminal justice, employment opportunities, health care services, or access to essential goods or services.
Your NJDPA Rights
Subject to applicable exceptions and limitations, New Jersey residents may have the following rights under the NJDPA:
Right to Access
You have the right to confirm whether Wind ’n’ Sails processes your personal data and to access that personal data.
Right to Correct
You have the right to request that we correct inaccuracies in your personal data, taking into account the nature of the personal data and the purposes for which it is processed.
Right to Delete
You have the right to request the deletion of personal data concerning you, subject to exceptions permitted by applicable law.
Right to Data Portability
You have the right to obtain a copy of personal data held by Wind ’n’ Sails in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the data to another entity without hindrance.
Right to Opt Out
You have the right to opt out of the processing of your personal data for:
- Targeted advertising
- The sale of personal data
- Profiling in furtherance of decisions that produce legal or similarly significant effects
Wind ’n’ Sails does not currently sell personal data or engage in profiling in furtherance of decisions that produce legal or similarly significant effects concerning consumers.
You may exercise your right to opt out of targeted advertising through our Privacy Preferences page.
Sensitive Data
Wind ’n’ Sails will obtain consent before processing sensitive data where consent is required under the NJDPA.
Where the processing involves personal data concerning a known child, Wind ’n’ Sails processes such data in accordance with applicable law, including the Children’s Online Privacy Protection Act (COPPA) where applicable.
Consumers Ages 13 Through 16
Where Wind ’n’ Sails has actual knowledge, or willfully disregards, that a consumer is at least 13 years old but younger than 17 years old, we will obtain the consumer's consent before processing the consumer's personal data for targeted advertising, the sale of personal data, or profiling in furtherance of decisions that produce legal or similarly significant effects, as required by the NJDPA.
Non-Discrimination
Wind ’n’ Sails will not unlawfully discriminate against you for exercising your rights under the NJDPA.
Exercising your privacy rights will not, solely because you exercised those rights and except as otherwise permitted by law, result in an unlawful increase in the cost or decrease in the availability of our products or services.
Authorized Agents
You may designate an authorized agent to exercise certain opt-out rights on your behalf, including through technology such as a website link, browser setting or extension, or global device setting where permitted by the NJDPA.
We may take commercially reasonable steps to verify your identity and the authorized agent's authority to act on your behalf, as permitted by applicable law.
Universal Opt-Out Mechanisms
Where required by the NJDPA, Wind ’n’ Sails recognizes qualifying universal opt-out mechanisms that communicate your choice to opt out of the processing of personal data for targeted advertising or the sale of personal data.
When we receive and can recognize a valid universal opt-out signal applicable to you, we will process it in accordance with applicable law.

Submitting and Authenticating Privacy Requests
To protect your personal data, we may take commercially reasonable steps to authenticate requests before processing them.
Depending on the request, we may:
- Compare information submitted with information maintained in our records.
- Request additional information reasonably necessary to authenticate the request.
- Decline to act on a request if we cannot reasonably authenticate it, as permitted by law.
We do not require authentication of an opt-out request, although we may deny an opt-out request where we have a good-faith, reasonable, and documented belief that the request is fraudulent. If we deny an opt-out request on that basis, we will provide notice as required by applicable law.
Response to Privacy Requests
We will respond to an authenticated privacy request within 45 days after receiving the request.
When reasonably necessary based on the complexity or number of requests, we may extend the response period by an additional 45 days. If an extension is necessary, we will notify you within the initial 45-day response period and explain the reason for the extension.
Information provided in response to a consumer request will be provided free of charge once during any 12-month period. If a request is manifestly unfounded, excessive, or repetitive, we may charge a reasonable fee to cover administrative costs or decline to act on the request, as permitted by the NJDPA.
Right to Appeal
If Wind ’n’ Sails declines to take action on your privacy request, you have the right to appeal our decision.
You may submit an appeal through our Privacy Preferences page by selecting “Appeal a Decision” as the request type, if available, or by contacting us at privacy@windnsails.com and clearly identifying your request as a privacy appeal.
We will respond to an appeal within 45 days after receiving it and provide a written explanation of our decision.
If your appeal is denied, we will provide information about how you may contact the New Jersey Division of Consumer Affairs to submit a complaint, as required by applicable law.
