Oregon Privacy Rights
This section provides additional information for Oregon residents under the Oregon Consumer Privacy Act (OCPA). The terms used in this section have the same meaning as defined under the OCPA. This section does not apply to deidentified or publicly available information as defined under the OCPA.

Data “Selling” and Targeted Advertising
Wind ’n’ Sails processes personal data for targeted advertising as defined under the OCPA. This may include:
  • Personal Identifiers
  • Internet Activity
  • Commercial Information
This allows us to display advertisements tailored to your interests.
  • Opt-Out: You have the right to opt out of the processing of your personal data for targeted advertising by visiting the Privacy Preferences page.
  • No Sale of Data: Wind ’n’ Sails does not sell personal data as defined under the OCPA.

Profiling
The OCPA provides consumers with the right to opt out of certain profiling in furtherance of decisions that produce legal effects or effects of similar significance.
Wind ’n’ Sails does not engage in profiling in furtherance of decisions that produce legal effects or effects of similar significance.

Your OCPA Rights
Subject to applicable exceptions and limitations, Oregon residents may exercise the following rights regarding their personal data.

Right to Confirm and Access
You have the right to:
  • Confirm whether Wind ’n’ Sails is processing your personal data.
  • Access the personal data Wind ’n’ Sails processes about you.

Right to Correct
You have the right to request that Wind ’n’ Sails correct inaccuracies in your personal data, taking into account the nature of the personal data and the purposes for which it is processed.

Right to Delete
You have the right to request that Wind ’n’ Sails delete personal data about you, subject to applicable exceptions permitted by law.
Where required, we will also instruct our processors to delete the applicable personal data.

Right to Data Portability
You have the right to obtain a copy of personal data that you previously provided to Wind ’n’ Sails in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the data to another person without hindrance.

Right to Obtain a List of Third Parties
You have the right to request a list of specific third parties to which Wind ’n’ Sails has disclosed:
  • Your personal data; or
  • Personal data generally.
We will provide the applicable information as required by the OCPA, subject to applicable exceptions.

Right to Opt Out
You have the right to opt out of the processing of your personal data for:
  • Targeted advertising
  • The sale of personal data
  • Profiling in furtherance of decisions that produce legal effects or effects of similar significance
Wind ’n’ Sails does not sell personal data as defined under the OCPA and does not engage in profiling in furtherance of decisions that produce legal effects or effects of similar significance.
You may exercise your right to opt out of targeted advertising by visiting the Privacy Preferences page.

Sensitive Data
The OCPA provides additional protections for sensitive data, including certain information concerning racial or ethnic background, national origin, religious beliefs, mental or physical health conditions or diagnoses, sexual orientation, citizenship or immigration status, status as transgender or nonbinary, status as a victim of crime, genetic or biometric data used for identification, precise geolocation data, and personal data of a child.
Where the OCPA requires consent before processing sensitive data, Wind ’n’ Sails will obtain the required consent before engaging in such processing.
As required by Oregon law, Wind ’n’ Sails does not sell precise geolocation data of Oregon consumers.

Children’s and Teenagers’ Personal Data
Wind ’n’ Sails does not knowingly process personal data of children in a manner inconsistent with applicable law.
Where Wind ’n’ Sails knows that a consumer is under 13 years of age, we will obtain any consent required from a parent or legal guardian before processing the child's personal data.
As required by Oregon law, Wind ’n’ Sails does not sell the personal data of consumers known to be under 16 years of age or process their personal data for targeted advertising or profiling.

Authorized Agents
You may designate an authorized agent to exercise your right to opt out of the sale of personal data, targeted advertising, or qualifying profiling on your behalf.
We will comply with an authorized-agent opt-out request when we can verify, using commercially reasonable efforts, the identity of the consumer and the authorized agent's authority to act on the consumer's behalf.
Authorized agents must submit opt-out requests through the methods described in this notice or on our Privacy Preferences page.
A parent or legal guardian may exercise applicable privacy rights on behalf of a child as provided by law.

Universal Opt-Out Preference Signals
Wind ’n’ Sails recognizes and honors qualifying universal opt-out preference signals, such as Global Privacy Control (GPC), as required by the OCPA.
When we detect a qualifying universal opt-out signal, we will treat the signal as a request to opt out of applicable processing, including targeted advertising and the sale of personal data, as required by Oregon law.
Because these signals are generally associated with a particular browser or device, you may need to enable the signal separately on each browser or device you use.

Submitting and Authenticating Privacy Requests
To exercise your applicable OCPA rights, please visit our Privacy Preferences page or contact us at privacy@windnsails.com.
To protect your personal data, we may take reasonable steps to authenticate your request before processing it.
Depending on the nature of your request, we may:
  • Match information you provide with information already maintained in our records.
  • Request additional information when reasonably necessary to authenticate your request.
  • Decline a request when we cannot reasonably authenticate it or when another basis for denial is permitted under applicable law.
We will not require authentication for an opt-out request except as permitted by applicable law. We may deny an opt-out request if we have a good-faith, reasonable, and documented belief that the request is fraudulent.

Response Timing and Fees
We will respond to an authenticated privacy request without undue delay and generally within 45 days after receiving the request.
When reasonably necessary, we may extend the response period by an additional 45 days, taking into account the complexity and number of requests. If an extension is necessary, we will inform you within the initial 45-day period and explain the reason for the extension.
We will generally provide information in response to your first request during any 12-month period free of charge.
For additional requests during the same 12-month period, we may charge a reasonable fee to cover administrative costs where permitted by the OCPA. We will not charge a fee for a request made to confirm that we corrected or deleted personal data in response to a prior request, as provided by law.

Right to Appeal
If Wind ’n’ Sails denies your privacy request, in whole or in part, you have the right to appeal our decision.
To submit an appeal, visit the Privacy Preferences page and follow the instructions for submitting a privacy appeal, or contact privacy@windnsails.com and clearly indicate that you are appealing a privacy-rights decision.
We will respond to your appeal in writing within 45 days after receiving it and will explain any action taken or not taken in response to your appeal, including the reasons for our decision.
If your appeal is denied, we will provide information about how you may contact the Oregon Attorney General to submit a complaint.

Non-Discrimination
Wind ’n’ Sails will not discriminate against you for exercising your rights under the OCPA.
We will not unlawfully deny goods or services, charge different prices or rates, or provide a different level or quality of goods or services because you exercised an applicable privacy right.
