Virginia Consumer Data Protection Act (VCDPA) Notice – Wind ’n’ Sails
Virginia Privacy Rights
This section provides additional information for Virginia residents under the Virginia Consumer Data Protection Act (VCDPA). Terms used in this section have the meanings given to them under the VCDPA.
The VCDPA generally applies to Virginia residents acting in an individual or household context and does not apply to individuals acting in a commercial or employment context. This section does not apply to deidentified or publicly available information as defined under the VCDPA.

Data “Selling” and Targeted Advertising
Wind ’n’ Sails may process personal data for targeted advertising as defined under the VCDPA. Depending on how you interact with us, this may include:
  • Personal Identifiers
  • Internet or Other Electronic Network Activity
  • Commercial Information
Targeted advertising may involve displaying advertisements selected based on personal data obtained from your activities over time and across nonaffiliated websites or online applications.

Targeted Advertising
You have the right to opt out of the processing of your personal data for targeted advertising.
To exercise this right, contact privacy@windnsails.com and identify your request as a Virginia Targeted Advertising Opt-Out Request.

Sale of Personal Data
Wind ’n’ Sails does not sell personal data for monetary consideration as “sale” is defined under the VCDPA.

Profiling
The VCDPA provides Virginia consumers with the right to opt out of profiling in furtherance of decisions that produce legal or similarly significant effects.
Wind ’n’ Sails does not use personal data to make decisions that produce legal or similarly significant effects concerning consumers through such profiling.

Your VCDPA Rights
Subject to applicable exceptions and limitations, Virginia consumers may have the following rights:

Right to Access
You have the right to confirm whether Wind ’n’ Sails is processing your personal data and, if so, to access that personal data.

Right to Correct
You have the right to request correction of inaccuracies in your personal data, taking into account the nature of the personal data and the purposes for which it is processed.

Right to Delete
You have the right to request deletion of personal data that you provided to us or that we obtained about you, subject to applicable exceptions permitted by law.

Right to Data Portability
You have the right to obtain a copy of personal data that you previously provided to us in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the data to another controller without hindrance, where the processing is carried out by automated means.

Right to Opt Out
You have the right to opt out of the processing of your personal data for purposes of:
  • Targeted advertising
  • Sale of personal data
  • Profiling in furtherance of decisions that produce legal or similarly significant effects
Wind ’n’ Sails does not sell personal data for monetary consideration as “sale” is defined under the VCDPA and does not engage in profiling in furtherance of decisions that produce legal or similarly significant effects concerning consumers.

Right to Non-Discrimination
Wind ’n’ Sails will not discriminate against you for exercising your rights under the VCDPA, including by unlawfully denying goods or services, charging different prices or rates, or providing a different level or quality of goods or services because you exercised a VCDPA right.
This does not prevent Wind ’n’ Sails from offering programs or benefits permitted by applicable law, including voluntary loyalty, rewards, premium features, discount, or similar programs.

Sensitive Data
The VCDPA provides additional protections for certain sensitive data, which may include information concerning racial or ethnic origin, religious beliefs, health diagnoses, sexual orientation, citizenship or immigration status, genetic or biometric data used to uniquely identify an individual, personal data collected from a known child, and precise geolocation data.
Where required by the VCDPA, Wind ’n’ Sails will obtain appropriate consent before processing sensitive data and will process personal data concerning known children in accordance with applicable law.
Wind ’n’ Sails does not sell or offer for sale precise geolocation data.

Exercising Your Virginia Privacy Rights
You may submit a request to exercise an applicable Virginia privacy right by contacting:
Please identify the privacy right you wish to exercise and provide sufficient information for us to identify and process your request.
You are not required to create a new account solely to exercise your VCDPA rights. If you already maintain an account with us, we may ask you to use your existing account when appropriate.
We may request information reasonably necessary to authenticate your identity and your request. If we are unable to authenticate your request using commercially reasonable efforts, we may request additional information reasonably necessary to authenticate the request.

Response Timing
We will respond to an authenticated consumer request without undue delay and generally within 45 days after receiving the request.
When reasonably necessary due to the complexity or number of requests, we may extend the response period once by an additional 45 days. If an extension is required, we will notify you within the initial 45-day period and explain the reason for the extension.
Information provided in response to consumer requests will generally be provided free of charge up to twice annually per consumer.
If a request is manifestly unfounded, excessive, or repetitive, we may charge a reasonable fee to cover the administrative costs of responding to the request or decline to act on the request, as permitted by the VCDPA.

Right to Appeal
If Wind ’n’ Sails declines to take action on your privacy request, you have the right to appeal our decision.
To submit an appeal, email privacy@windnsails.com and include “Virginia Privacy Appeal” in the subject line, together with sufficient information for us to identify your original request and the decision you are appealing.
We will respond to your appeal within 60 days after receiving it and provide a written explanation of the action taken or not taken in response to the appeal.
If your appeal is denied, we will provide information about how you may contact the Virginia Attorney General to submit a complaint.

Additional Information
The rights described in this notice are subject to the exceptions, limitations, and requirements of the VCDPA and other applicable laws.
We may retain or process personal data where permitted or required by law, including when reasonably necessary to comply with legal obligations, establish or defend legal claims, prevent or investigate security incidents or unlawful activity, perform a contract or provide a product or service requested by you, or otherwise exercise rights permitted under applicable law.
